- THTran’s HardwareOct 7, 20251.0Had a gun shipped there to pick up. -Guy told me he was doing me a favor because there's a "10 day waiting period" -Told me I can't pick up the gun with my ID even though it's a Texas ID, because of my "residence". -Told me it's "because of the ATF" and lied to me on two things in one go and said he was doing me a favor. Had to come back with orders to pick up my weapon. The facts: -No federal waiting period, it's by state. ATF Regulation: 27 C.F.R. § 478.29 "This section shall not preclude any person who lawfully acquires a firearm in one State from transporting or receiving it in the same State." -The ATF defines residence by STATE, not by "city" because I reside in Killeen. Cited 27 CFR 478.11 “State of residence”. Wasted my drive there and back. Made me go print my orders, overall wasting about an hour or so of my day. I have done an FFL transfer here before but I won't be doing it again. Edit: The owner decided to be more wrong. The Office of Consumer Credit Commissioner does NOT regulate firearm sales over the age of 21 with a federal hold. This may ONLY apply if the background check does not IMMEDIATELY go through. Mine did. Check Finance Code, Chapter 371 in Pawnshop Act. Secondly, my address IS correct. If I worked in the oil field 4 days a week and went home 3 days a week, my “residence” is still considered the city in which I live in. Because I have an address here does NOT mean I consider it a primary residence. All of my paperwork goes back to my city of residence STILL WITHIN TEXAS. ATF defines where you live by state, not by address and city in which I live in. If I have not moved out of the state and consider my other residential address as my primary residence, in which I told you, then it is.
